Meaning of "this Court"
Settle a bet. Does "this Court" mean:
1) This district court, no matter the judge
2) Just this judge
3) just this judge in this case

Context matters, but usually to me it means #1. Add parenthesis or something if you want it to mean a specific judge.Anonymous User wrote:Settle a bet. Does "this Court" mean:

Number one. If you want to scream "LOOK AT THIS OPINION YOU AUTHORED," put the judge's name in the cite.

TCR is "it depends." One could make an argument that, due to the capitalization, it refers to the judicial body (#1), but practically speaking, it's not going to be read that way if the context doesn't make sense. If you need a source for the argument that it's #1, see TMOUS 3.09.

In my experience, having clerked on the district court, "this Court" means #1. "The Court" is what you'd use for 2 or 3.
