Exactly my point. Ignore the post if it bothers you. Moreover, the anaylses wasnt posted directly on the page.Findedeux wrote:I wasn't really being legal.NotYourAvocado wrote:Lol those two things are completely unrelated. We already paid quite a bit of money for it.
The NCBE isn't going to go out of its way to sue someone for this kind of disclosure and no one here really needs to worry about legal repercussions. So when you report this isn't not because its a legal problem, it's because it bothers you.

That's interesting - yeah, vaguely recall hearing about that. I wonder though what the limitations are. It would be strange if the application of this rule automatically denied all copyright protection to materials that are primarily educational (because I guess that is the exception you're referring to). And again, there must be a difference between posting the movie on a file share server (even for free) and showing the same in a classroom (probably without charging the kids...). Regardless of the genre ("educational" or not). But the lines may be blurry for sure...sammyveritas wrote:Thanks for this little distraction--- I see your point, but there is one exception in copyright law---fair use--if dissemination was not commercial (free), and was for educational, research, commentary, parody, etc., purposes, then this share would not likely violate copyright lawNotYourAvocado wrote:Hm well not an IP lawyer here, but maybe there was also a bit of a copyright issue - kind of like uploading a copyright protected movie onto a torrent server? Totally understand your point. There is something to be said, though, about lawyers learning from early on how to not be bothered by things that we know are illegal / infringe a valid right...Raheemat1 wrote:Exactly my point. Ok, so copying and sharing the commercialized $200 casebook data with 100 friends does not give the authors a right to stop it even though the author loses opportunity to sell it to 100 students, as long as that person is just showing his generosity and not making any money out of it. Hmm, what is the difference between pirates and generosity then?sammyveritas wrote:Thanks for this little distraction--- I see your point, but there is one exception in copyright law---fair use--if dissemination was not commercial (free), and was for educational, research, commentary, parody, etc., purposes, and didn't upload directly to site either, so not likely to take away from the market....so no commercial purpose, and no definite impact on market, then this share would not likely violate copyright law...NotYourAvocado wrote:Hm well not an IP lawyer here, but maybe there was also a bit of a copyright issue - kind of like uploading a copyright protected movie onto a torrent server? By the way, don't know if you ever came across this article from 2014. A bit dated, but made me think that there must be some technical link between closure of the address change option and release (or at least readiness) of results.

I'm unsure that's entirely analogous to the points being made here though. For a start, the NCBE is a not for profit organization whose main remit inter alia, is to determine through examination, whether candidates to the bar possess the requisite competence to qualify as attorneys. Bar candidates, especially those who have paid for the examinations, have a genuine interest and expectation to be able to review, re-appraise, compare or otherwise reanalyse their performances on a prior examination in comparison with the standards they were set against without needless let or hinderance. On the other hand, your friends do not have any legitimate expectation to freely access a "commercialized $200 casebook date" from a third party whose sole interest is profit making.PuzzleBubble wrote:Ok, so copying and sharing the commercialized $200 casebook data with 100 friends does not give the authors a right to stop it even though the author loses opportunity to sell it to 100 students, as long as that person is just showing his generosity and not making any money out of it. You can blame that on results wait induced stress. Needed some distraction...kris4842 wrote:can we end this topic about copyright...it wasn't on the Bar! can we please get back to the anxiety and stress?

That's quite interesting! When I failed last time out, I was able to view my receipt until result was released... Or so I think.

Re: New York July 2018 Bar Exam Hangout Thread
This entire process has been extremely annoying, frustrating and everything under the sun. I think it would've been easier to deal with if there was a definitive date like other states have. I mean, to say "October 22nd" can't be that hard, right? Other states do it. Even California announced a date and time. Excuse my rant.
Seriously? What are you waiting for?
