Guy didn't respond to me. Not really sure I understand why set 17 would randomly be the same across all learners when the other sets have been random.

Have we confirmed they are random? I haven't done 17 yet but for set 16 these are my (seven) civ pro questions for someone to compare to.

Part of a small group that's doing them together. The others (including 18 and 19) have all been different for us. Some questions overlap, of course, but not identical. 17 was the same, all 100 questions. Don't know why either (maybe because it was 100 questions, kind of more like the practice exams).

My 17 is only 50 questions. There is a 100 question set, but it's actually unnumbered (and placed between 12 and 13 on list).

Weird. My unnumbered 100 question set is between mixed set 4 and 5.

Must vary by state then. Would still guess that the 100-question set is consistent for everyone, but I don't have anything to back that up.

Same. My 100 question set came several weeks ago.

I just finished session 6 (really annoying question about intended third party beneficiaries and detrimental reliance re suing on breach of K) and noticed that the goal was 70%.

How high does the goal get at the end of the sessions?

I think it's 70 throughout.

I am very confused about Rule 20 permissive joinder and Rule 24 intervenor. Seems like both are joining plaintiffs. Could anyone explain me what the real difference is?

Interveners have to satisfy the same diversity/amount requirements as a normal plaintiff, but permissive joinder can happen even if the amount of controversy is not enough.

How would I answer a question like this? Can you apply racial gerrymandering rules to this, or would I just answer it like an affirmative action question and apply strict scrutiny?
I think this is one of the weirdly specific con law questions. I believe it's actually about congruent and proportional remedies. I believe a prior Supreme Court case has said that busing within a district is okay because it is congruent and proportional, but busing between districts is not. That could apply to a redistricting question. Without knowing that case, though, I dont know how else you could reason yourself to that answer.

Does anyone know if there's a safe number of mixed sets you should get through before feeling a little safe? Just got through 11 plus the 100-question set and then PT4 destroyed me.

Is anyone else still encountering new MBE concepts they have never before encountered? I'm on set 19 and I just got 3 questions in a row on things I have never even heard of before. This is freaking me tf out for Wednesday

yeah but I assume it's more of a matter of them having saved the obscure exceptions for the end rather than you not knowing enough to do ok on the real thing

At this point I am more concerned with memorizing as much as I can for MEE questions.
I crunched all the essay pq's down to one page statements of law and have grouped them together, then crunched them down even more. Hopefully that' a good strategy.

anybody else feel unprepared but also feel like they no longer care?

At 97.5% completion. Have 3 more essays that themis recommends we outline. I should probably write them out in full but I kind of don't care anymore.

I am actually really concerned that I did not practice more than 2 MPTS during the whole course - one persuasive and the other and objective memo.

Is this going to be a big problem? Should I do some tomorrow maybe?

I couldn't get the effort up to practice CPT to be honest. I outlined two quickly, and then on the graded one I got 70/100 (for whatever Themis graders are worth). They honestly felt pretty straight forward to me to be honest. And I'm not sure how much value I'd get from practising more.

I'm trying to learn Wills and Trusts.

Basically, have only done the lectures.

Then I have to outline a thousand essays, take practice exam #4, review all mbe subjects, and then outline half a dozen MPTs.

:D

I do not know what the CPT is but if its like the MPT... I too have only done two. Got an 83% on the graded and have not looked back.

There is so much I do not know that I have decided to stop caring and trust I know enough to pass. Minimum competency folks. I'll be putting in 8 hours tomorrow and probably 6-8 on Monday because I can't not but I stopped at 4 today... which was still 7 hours. Felt great.

I don't really feel prepared for the MPT because I always feel like I mess up the structuring or something, so I spent a couple hours today looking through all the sample MPTs Themis provided, along with the drafter's sheets and the sample answers. I didn't try to outline them or anything, just wanted to get a feel for the different types that can come up and how to structure them. They are kind of intense and time-consuming so I don't know if doing more at this point would be helpful, but looking through them at least made me feel a little less nervous.

2 CA Evidence Questions if anyone can help:

1) Page 12 of the CA lecture notes that in a criminal case a "witness's" character can be bolstered without any attempt to impeach with reputation, opinion, and specific acts; the main outline just says criminal "defendant" - anyone know if it works for any witness or if just the defendant?

2) For public records, can police records be used against a criminal in CA? Page 26 of the lecture seems to indicate it, but I can't find anything to back it up in the outline.

Thanks!

Seriously? What are you waiting for?
