Character and Fitness. The whole process we're doing is "Admission by Examination." The Office of Court Administration divides NY into four Judicial Departments. For our purposes, that determines where you send your application to. I heard 3rd Dept. typically has the quickest turn around. Is each department simply based on where you live? Better off waiting until the results come out before sending in any application paperwork, or will that significantly delay being sworn in at an earlier time frame? 2nd dept. here, I'm going to wait for the results before I do anything.

As for waiting, I hear you. Are you just waiting on C&F (i.e. no NYLC nor MPRE)? If you do wait, you will be sworn in later, but you don't have to worry about renewing your affidavits - which have a 60 Day time limit.

You might want to double check the 60 day expiration thing. That seems to be a piece of information getting passed around but I know for a fact that is not true of the 1st Department because I called to ask.

I was assigned to the Third Department. If your current employer doesn't know that you sat for the NY Bar Exam (practicing in another state), how would you recommend handling the "Law Related Employment" section of the admissions packet? Is it common to delay applying for admission after getting your bar results?

I should’ve been clearer, my mistake. My post was about the Second Department, as the poster was concerned about when to apply, and the info’s relevant to that post. The real answer is “it depends” (like everything else. It’d probably be nice to give your employer a heads up since they’re going to be contacted (you can do it after the results). Regarding legal employers, the Departments are clear as to what counts (particularly for your 50 hour requirement), and how the affidavit is to be sent. If there’s anything I’d “recommend”: look at your relevant application and get your info together - before you apply. I’ve already avoided so much stress by doing that. An amended application (a result of forgetting stuff and/or your being crunched for time) is a real pain, and can significantly delay your clearance & swear-in. (this is especially relevant for those applying to the 4th Department) Added bonus: you can do something else while waiting for 3 weeks from now

The above basically puts April 24-26 (Tues-Thurs of of April’s 4th week) as the “safe zone” for results. Mark your calendars

I'm not sure what to make of this. It's definitely not good, BUT, I failed NY by 4 points last July w/ a 131 MBE and definitely was below average on at least 1/2 of the MEE. 1 MPT was substantial above average & the other was basically below average by the same amt. of points, so that was a wash for me...meat tornado wrote:Yeah, with a 132 national MBE median, this is going to be a complete bloodbath. Anyway, point: I don't know that a 132 average MBE is necessarily a death sentence unless you know that you royally fucked up like half the MEE or something. It may not put you in the 280s, but the 266 seems do-able.
