NYS 3rd Dept Certification
Anyone know how long it takes BOLE to certify out of state NY bar exam takers to the 3rd dept?

Re: NYS 3rd Dept Certification
I think they certify in and out of state folks at the same time. In any event I think you're supposed to send the Third Department a copy of the letter as an addition to the application -- more on this here: https://www.nycourts.gov/ad3/Admissions ... onExam.pdf (see Step 3).
Is anyone else prepping their materials to send asap (don't mean to jinx anything though whoops)?

I'm 1st Department so I can't send anything early, but I'm going to prep everything in September/early October so that I have everything ready for score release (just in case I do pass).Toubro wrote:I think they certify in and out of state folks at the same time. Any foreign attorneys that can shed some light here, please? I had to send certificates from my foreign law school and bar already for the bar exam application. Do I have to send them all over again? It's been a pain in the neck the first time around

NY is very redundant in that BOLE is a separate entity from any of the 4 departments unfortunately.Asroma wrote:Any foreign attorneys that can shed some light here, please? I'll wait to know if I passed then, I don't want to go through that again if I don't. Thanks though.hockeyman969 wrote:NY is very redundant in that BOLE is a separate entity from any of the 4 departments unfortunately.

For the third district, if we send in materials before July bar results come out but end up failing , do we risk having to send in C&F materials all over again if we fail but subsequently pass on a later administration?

Re: NYS 3rd Dept Certification
I think I'm going to move myself to the First Department anyway, I think. And figured it'll be faster to start prepping all this material now when I am relatively more free. I saw people in the class above me get sworn in as late as June and I don't want such a long delay hahaSlytherpuff wrote:I'm 1st Department so I can't send anything early, but I'm going to prep everything in September/early October so that I have everything ready for score release (just in case I do pass).Toubro wrote:I think they certify in and out of state folks at the same time. No not the application itself or the employment affidavits but I heard somewhere your moral character (2) affidavits have to be recent- something like w/in the past 60 days so hold off on doing those until you get your results.

I thought we didn't find out what department we were in until they emailed us? And how do you know what materials to prep, I assumed we would also get that list eventually based on the department? Is there some way to find these things out in advance to get a head start?

Re: NYS 3rd Dept Certification
The department is based on your address (out of staters default to the third). And the materials needed are here, along with general instructions. Departments have their own rules with respect to timing and such, which you can investigate on their respective websites:FedFan123 wrote:I thought we didn't find out what department we were in until they emailed us? First Department (for everyone based in Manhattan or "NY County")
Second Department (if you're living in Queens, Brooklyn, Long Island, etc.) (this is also the only one I see that has the 60-day expiration on the moral character affidavits CNK was talking about)
Third Department (good old Albany!)
Fourth Department (Buffalo?)

Thanks man good stuff. Just one other question since you seem to know a lot more than me. Right now I am an "out of stater" so I guess I would be Third Department. But I have signed a lease for my Manhattan apartment that will begin on September 1. Thus, will I still be a third department guy or should I plan on being a first department guy? Thanks!

Re: NYS 3rd Dept Certification
So if you change your address prior to BOLE's certifying you, they'll certify you to the the first department if you change your address here by 10/15.FedFan123 wrote:Toubro wrote:The department is based on your address (out of staters default to the third). ETA I'd also just call them to confirm that once haha.

Re: NYS 3rd Dept Certification
Oh cool! Thanks again. So the reason why you would want to switch from the 3rd to 1st department is so that you would be able to do your interview and swearing ceremony in Manhattan rather than having to travel to Albany right? Or is there some other relevant reason for switching departments? Sorry for another question lolToubro wrote:So if you change your address prior to BOLE's certifying you, they'll certify you to the the first department if you change your address here by 10/15.FedFan123 wrote:Toubro wrote:The department is based on your address (out of staters default to the third). Re: NYS 3rd Dept Certification
No worries! I think that's the main reason, and the other is that it's generally a good idea to keep BOLE (and then, by extension, the NY courts) apprised of your current address for general housekeeping.FedFan123 wrote:
