trustee fiduciary duties:
duty of care and loyalty
separate, don't delegate
preserve and make productive
in ways the set-eh-lor* demands

*settlor but poetry stops for no bar prep

duty of loyalty for trustees:
don't add or take from or to the trust
or give one's self a gain
corporate trustees can't buy from self, but they can retain
[+ regular stuff]

contract remedies:
D:RECL SpREC-L ("dreckle spreckle")
damages: restitution, expectation, consequential, liquidated
specific performance, recission, reLoaded*
*= reformation but i wanted it to rhyme

most ppl prob don't need these but i'm an idiot so

Also, I've been using this anagram solver to form words / phrases out of a bunch of random letters.

Quizlet was fantastic! Taking the exam in 10 days. No time to come up with my own. This was a life saver. Thank you!

It works because kids should run from all of the above.

Something similar might already be here, but it's so close to the bar that I don't necessarily want to go through all of the pages.

When the parol evidence rule doesn't apply: SCAM FRAUD (sort of gives you a flavor of when it does not apply, with the exception of a couple, like Subsequent/Collateral Agreements and Reformation).

Subsequent Agreements
Collateral Agreements
Absence of Consideration
Mistake
Fraud
Reformation
Attacks on Validity
Undue Influence
Duress

If anyone is taking PA, let me know. I've managed to compile a few mnemonics specific to PA.

A lot of my mnemonics were based off of a hobby of mine: tennis (I watch it and play it). For instance, when I was trying to devise a way to remember the order of payment for creditors of insolvent estates (Florida Wills), it went like this:

1. Expenses of administration
2. Funeral expenses up to $60K
3. Medicaid
4. Expenses of last illness
5. Family allowance
6. Child support
7. Decedent's business debts
8. Other claims

1. Andy ("A" for Administration)
2. Fucking ("F" for Funeral)
3. Murray ("M" for Medicaid)
4. Might ("M" for Medical/illness)
5. Fight ("F" for Family allowance)
6. Cilic ("C" for Child support)
7. Djokovic ("D" for debts)
8. and Ostapenko ("O" for other)

lol
