What happens if, while you're clerking for an appellate judge, that judge gets confirmed to the Supreme Court? Does the judge typically take his clerks with him? I imagine clerks to Sotomayor went through something similar when she was on the 2nd circuit

Thanks for link. Interesting, seems like Sotomayor is the only justice that didn't take at least some of her old clerks with her. Tough luck... :O

Souter was promoted from NH Supreme Court to 1st Cir. to SCOTUS in a very short time (I think less than 1 year) and at least one of his clerks came with him.

Right now, Gorsuch's clerks are waiting to see whether he is confirmed for sure. They are unable to try to find new opportunities unless/until Gorsuch is officially confirmed. Then they'll have to either find a new clerkship (with a newly appointed judge or otherwise) and fill in any gaps at a firm.
