Tips on Attacking Evidence?

Evidence is a beast. Any tips on attacking this class?

This probably needs some updating, but still helpful:

I don't think you need a special plan for Evidence. In many respects, it's a more straightforward subject—or at least it's taught in a more straightforward way—than 1L classes like Contracts, Torts, and Crim.

I would just follow the professor's lead for thee of four weeks. If you're struggling, get a supplement.

Also, watch "My Cousin Vinny." And if you've already seen it, watch it again.

If your prof is into some more theoretical stuff (e.g. Bayesian analysis, admissibility of forensic evidence, etc.) track that. Otherwise the analysis on every single questions is basically the same:

1) Is it relevant?
2) Is it admissible on its own/for truth?
3) Admissible for some other purpose?
4) Is it hearsay?
5) Is it authenticated?

If you aim to be a litigator, just start working on memorizing FRE now, it's one of the more useful things you learn in law school.

Definitely consider a supplement for this class. I actually do stand by the opinion of law professors who (at least used to) go on about how supplements should not completely take the place of the case books. But it really helps to have one to confirm what you're learning in the case books for difficult classes such as Evidence.

Evidence will start to make more sense later in the semester once your brain starts to figure out how to apply the rules together.

Read the rules, and the annotations.

Understanding what is and what is not hearsay was the hardest for me. Get a good supplement and then take some practice tests. Here is a site with some good information.

Here is the MBE practice test
