Lateral Conflicts

Creating a separate topic on conflicts checks for laterals.

A. Below is my understanding. It would be helpful if anyone can shed light on the behind-the-scenes process of conflicts screening.

1. Attorney submits conflicts screening forms with names of all clients and matters attorney has worked on throughout his or her career.
2. New firm’s conflicts department submits all of the attoney’s information into a database to see if there are any conflicts.
3. If there are any potential conflicts or any client/matter that require additional information, then conflicts department follows up with new attorney. New attorney updates information.
4. Conflicts department submits updated information into database.
5. What’s next? What slows down the timeline? What can expedite the timeline?

B. What is the best professional way to work with the conflicts or recruiting department during conflicts check?

1. Brief follow-up email ater 2 weeks or no follow-up at all?
2. Do you continue to update the conflicts department on new matters you are staffed on?
3. What are the consequences if you providence notice before clearance from the conflicts?
